Medical only

Pennsylvania allows medical marijuana for registered patients and caregivers. Adult-use, or recreational, cannabis is not legal as of our last update. Our legalization tracker has the full record.

Who can buy

Registered patients with a valid Pennsylvania medical marijuana ID card can buy at permitted dispensaries. Cards only go to Pennsylvania residents, and out-of-state cards are not accepted.

Patients under 18 need a caregiver. Caregivers must be 21 or older unless the Department of Health allows otherwise, and they must pass a background check. A patient can name up to two caregivers.

What forms are allowed

The law allows pills, oils, topicals, tinctures, liquids and forms for vaporization or nebulization. Department of Health rules also allow dry leaf or plant form for vaporization.

No smoking, no edibles for saleSmoking medical marijuana is not allowed. Dispensaries cannot sell edibles, but a patient or caregiver can mix medical marijuana into food to help the patient take it.

Supply and carrying it

A dispensary can give you up to a 90 day supply. Keep unused medicine in its original package, and carry your ID card whenever you have it with you. See units and supply limits for how it is counted.

Work and school

Employers cannot fire or discriminate against you just for being a certified patient. They do not have to allow use at work, and they can discipline someone working under the influence. Some jobs, like work at heights or in confined spaces, have stricter limits.

Under state guidance, a parent or caregiver can give medical marijuana to a student on school grounds with a patient authorization letter. Students can never carry it themselves.

Driving

Pennsylvania's DUI law covers driving with any amount of a Schedule I substance or its metabolite in your blood. There is no exception for medical patients. A bill to add one has been introduced but has not passed. Do not drive after using.

Home grow

Growing marijuana without a state permit is illegal in Pennsylvania, including for patients. A bill to allow patient home grow has been introduced but has not passed.

Philadelphia's own rules

For people without a card, state law treats possession of up to 30 grams of marijuana as a misdemeanor. Philadelphia's code treats possessing a small amount as a civil violation with a $25 fine. Smoking marijuana in public is a $100 fine in Philadelphia.

Crossing state lines

Taking cannabis across state lines is illegal under federal law, even between two states where it is legal. Pennsylvania only allows medical marijuana dispensed by a Pennsylvania dispensary to a Pennsylvania cardholder.
